CA FSBO SALE FACILITATION PROCESS

  • I prefer to facilitate both sides as the transaction goes more smoothly, the many steps progress more efficiently, and I am the only one doing the paperwork so it is done correctly (often not the case with separate representation).

  • Both sides facilitation is performed with complete transparency and appropriate disclosures.  ALL communication is by email to all parties.  Our Engagement Agreement states this: 

    1.   Capacity Disclosure – Collaborative Dual Representation.  

    a.   Clients understand that Attorney is also a real estate broker but is not acting as a real estate agent or broker in this transaction.

    b.  The parties acknowledge that they are solely responsible for evaluating the subject property (including value, condition and feasibility) and that attorney is purely facilitating the sale through closing.

    c.   In order for the transaction to be collaborative and entirely transparent, allowing attorney to facilitate both sides of the sale, all communication is by email with all parties copied.

    d.  The parties are encouraged to each hire their own attorney to review this transaction and will either do so or intelligently waive this right.

  •  When Seller and buyer have agreed to price and closing date, email me. When Seller and Buyer have agreed to price and closing date, email me.

  •  I then prepare an Engagement Agreement & Facilitator Disclosures for the parties to sign and calling for credit card numbers [half fee is charged after Purchase Agreement is prepared, the rest is paid when all services are complete]. 

  • I then send out a Purchase Agreement Questionnaire for Buyer and Seller to complete collaboratively.  With that in hand, I prepare the Purchase Agreement.  

  • All documents are signed on my digital platform.

  • When your FSBO is advertised, if you do not want to pay a buyer’s agent, advise potential buyers that you have an attorney lined up who will facilitate both sides.  Give them this link and suggest they read the reviews at the bottom of the page.

  • To give clients the option of receiving offers from agents, I am now willing to facilitate just the Seller side.  The fee is more than half both side facilitation because of the extra work involved when there is agent involvement.

  • To accommodate the post 8/2024 buyer agent compensation dilemma,   I am now willing to facilitate just the Buyer side.  Again, the fee is more than half both side facilitation because of the extra work involved when there is agent involvement.
